*Occasionally US Airways may post contests on US Airways’ Twitter® feed. Such contests shall be governed by, and the individuals who respond to such contests shall be bound by, these terms and conditions. No purchase necessary to enter or win. Correctly respond to the contest inquiry posted on US Airways’ Twitter feed and follow the links and instructions provided, including accepting these terms and conditions. You may be required to submit your name, address and other information deemed necessary by US Airways in order to receive or redeem the prize. All information submitted will be subject to US Airways’ privacy policy as set forth on its website or otherwise publicly disseminated. Only one prize per person, per Dividend Miles account can be claimed from US Airways. b. US Airways is not responsible for entries not received or delayed due to difficulty accessing Twitter or the internet, service outages or delays, computer or mobile device difficulties, or other technological glitches. 2. Contest is open to all legal residents of the United States, 21 years old and older, except for the officers, directors, agents and employees of US Airways, Inc., Twitter, Inc. and the parent, subsidiary and affiliate companies of each, their advertising and promotional agencies, and the immediate families or household members of the foregoing. b. You must be a member in good standing of Twitter and be a follower of the official US Airways Twitter page during the promotional period in order to enter the contest. 3. Limitation of liability: a. US Airways and Twitter are not responsible for illegible, lost, late, incomplete, stolen, misdirected, postage due, or undeliverable Tweets, email or postal mail; or for any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, or availability, or garbled, corrupt or jumbled transmissions, service provider/Internet/web site/use net accessibility, availability, or traffic congestion, or any technical error, or unauthorized human intervention, or the incorrect or inaccurate capture of registration information, or the failure to capture, or loss of, any such information. US Airways and Twitter are not responsible for any incorrect or inaccurate information, whether caused by tampering, hacking, or by any of the equipment or programming associated with or utilized in the Contest and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical or typographical errors, theft or destruction or unauthorized access to website(s). b. By participating, each participant releases and agrees to defend, indemnify, and hold harmless US Airways and Twitter from and against any and all claims, demands, actions, causes of action, judgments, liabilities, damages, losses, costs, expenses (including, without limitation, attorneys’ fees) or any other injury, whether due to negligence or otherwise, to person(s) or property (including, without limitation, death or violation of any personal or proprietary rights, such as violation of right of publicity/privacy, libel, or slander) (collectively, “Claims”), due to, resulting from, or relating to, in whole or in part, directly or indirectly, participation in the contest, or any related activity or the receipt, possession, use or misuse, of any prize. c. If, for any reason, the contest is not capable of running as planned, US Airways reserves the right at its sole discretion to cancel, terminate, modify or suspend the contest and/or proceed with the contest in a manner it deems fair and reasonable, including, without limitation, selection of the winners from among eligible entries received prior to such cancellation, termination, modification or suspension. d. US Airways makes no warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose or non-infringement with regard to the contest or any prize. As some jurisdictions may not allow limitations of exclusion of liability for incidental or consequential damages or exclusion of implied warranties. Publicity rights: By accepting a prize, each winner agrees to allow US Airways and/or its designees the perpetual right to use his/her name, Twitter user name, biographical information, voice, photos and/or likeness (real or simulated), and statements for promotion, trade, commercial, advertising, marketing and publicity purposes, at any time or times, in all media now known or hereafter discovered, worldwide in perpetuity, including but not limited to on the World Wide Web and internet, without notice, review or approval and without additional compensation except where prohibited by law. In this regard, each winner hereby agrees to sign and deliver to US Airways any and all documents that US Airways may deem necessary or desirable in order to confirm such grant of publicity rights. 5. Governing law: Each contest and these terms and conditions are governed by and subject to the laws of the State of Arizona. Except where prohibited by law, any proceeding arising out of or related to any contest or these terms and conditions shall be brought in the federal courts located in Arizona. By participating in a contest, each participant irrevocably consents to the jurisdiction and venue of such courts.
